I believe I covered this in a previous post. Before any use of that 
material could occur, full legal clearance must be established. Clip 
clearance companies, such as Research Video, spend an enormous amount 
of time with such matters. Licensing and signed contracts with specific 
terms are always "in place" before any footage is sold.

I've been in edit sessions where we were doing the last and final edits 
on some music special. Always, there was some drama where something was 
going to have to be cut out of a show because of some legal or money 
issue, and something else would have to go into it's place. In the 
linear edit world, this was a scramble to meet a deadline. But 
producers out here are very careful to have the necessary clearances 
for domestic and international rights, and home video use.

Recently, I was in conversation with a producer about re-visiting a PBS 
music program that featured a very popular group from the 70's. The 
program had many music clips, stilll images, and interviews. There was 
a five year contract for these uses. The popularity of this program 
today presented a possibility of release for TV and/or DVD for some 
countries, such as Japan, S. Korea, and The Philippines. Ten years ago, 
not a problem. Today, big problem, as all rights would have to be 
re-negotiated. After some figuring, the idea has been temporally 
shelved.

One of my clients is still in contact with the=2
0PTL auctioneer. We will 
see what transpires. No matter what anyone's personal beliefs are as to 
content value or it's history, there is a market for such material. 
Some legacy religious broadcasts have more value than others. An entire 
library of various shows may have enough "gems" to make it worthwhile 
 from a business standpoint. However, all factors have to be analyzed to 
see if the speculative venture has a possibility.

Take Elvis for example: Yes, not a religious entity except for some 
praise songs and his roots in southern life. But when one gets a chance 
to happen upon some of these Elvis shrines in small towns, it is a 
reminder that, yes there is a deep "want" for some experiences of the 
past, whether it be musical icons or religious broadcasting 
personalities.

The problem with purchases off ebay and likely with the PTL tapes is 
that there are no rights attached to the content purchased. 
 

We're talking about the right to use the image, voice and name of the 
person or people on-screen, rights to use the songs performed and the 
music heard (two separate things) especially if union musicians are 
playing.

Unless there are file cabinets full of papers covering the above, it is 
much more difficult and expensive to pursue marketing products derived 
from such purchases.
