Time of broadcast or publication may make a difference. Also whether  
it's considered a "Published" or "Unpublished" work.

You'll have to determine whether the information is applicable to  
broadcasts or recordings of broadcasts.

Again, that differentiation between "Published" or not published may  
apply. Also whether the program was broadcast with any kind of  
Copyright markings in the picture or spoken... and whether there was  
any effort to copyright the program well after it was broadcast.

Hope this is of some help... rather than adding more noise to the  
picture.
